EB-5 India Per-Country Limit Reached for Fiscal Year 2026

The State Department has issued all available EB-5 unreserved immigrant visas for applicants chargeable to India for FY 2026. Here's what it means and when numbers reset.

As of June 5, 2026, the U.S. Department of State — working with U.S. Citizenship and Immigration Services (USCIS) — has issued all available immigrant visas in the Employment-Based Fifth Preference (EB-5) unreserved category for applicants chargeable to India for fiscal year 2026.

What this means

Because every available EB-5 unreserved visa for India has now been used for the fiscal year, U.S. embassies and consulates may not issue visas in these categories for India for the rest of FY 2026. This affects the unreserved EB-5 categories (C5, T5, I5, R5, RU, and NU).

The limit exists by law. Under the Immigration and Nationality Act, no single country can receive more than seven percent of the total employment-based and family-sponsored visas in a year, and EB-5 visas are capped at 7.1% of the worldwide employment limit.

When do the numbers reset?

The annual limits reset at the start of the new fiscal year — October 1, 2026 (FY 2027). At that point, embassies and consulates may resume issuing immigrant visas in this category to qualified applicants.

What you should do

If you or a family member is waiting on an EB-5 unreserved case chargeable to India, expect no further visa issuance in this category until the new fiscal year. Keep your documents current and watch the monthly Visa Bulletin for updated final action dates.
